Can I Get Workers Comp Benefits?

Georgia's Workers' Compensation Act generally mandates that any injury arising out of and during the course and scope of employment is compensable. Eligible injuries or accidents include, but are not limited to:

  • Repetitive motion injuries: If your job duties involve repetitive motions, such as typing, twisting, or other repetitive motions, you may be eligible for benefits to cover the damages of carpel tunnel syndrome, knee injury, back injury, or other repetitive stress injury.
  • Machinery injuries: Cuts or lacerations, infections from cuts, loss of limbs/amputation, and other workplace injuries caused by construction site accidents, industrial accidents, or other work equipment accidents are covered under workers' compensation.
  • Incident accident injuries: Negligence is not a factor in workers' compensation cases. It does not matter if a worker became injured even though he "did something stupid". Generally speaking, as long as the injury was accidental, it is covered. Therefore, a slip and fall accident, lifting injury, a fall down steps, an accident at a company softball game, or other accidents may result in approved workers' compensation benefits.

Accidents that occur during your commute to or from work are not typically covered. However, accidents that occur while performing a duty for an employer, such as running an employer's errand, are typically covered.
