Is Settlement Right for Me?

Neither an insurance company nor a claimant can be forced to settle a workers' compensation claim. However, settlement of the claim is possible at any stage if the parties are willing to come together to mediate. As experienced workers' compensation attorneys, we ensure that our clients' rights are protected in any agreement that may result from mediation.

Workers' Compensation Settlement Process

Some settlement agreements may be reached informally through negotiations over the phone with the insurance company or their attorney. However, many workers' comp cases are settled through mediations at the Office of the State Board of Workers' Compensation. A mediation is an opportunity for you, your attorney, and the insurance company to come together with a neutral third party to achieve an agreement. Meditation sessions usually last no more than one day, but can stretch longer if complicated legal issues arise.

If the parties agree to a settlement, the process generally works like this:

  • The insurance company drafts the settlement documents and sends them to our office for review.
  • We review the agreement, verify our client is protected, obtain client signatures, and return the agreement to the insurance company.
  • The agreement is then submitted to the State Board of Workers' Compensation for their review and approval. Every workers' compensation settlement MUST be approved by the board. It generally takes several weeks for them to approve the settlement.
  • Once approval is obtained, the insurance company will have 20 days from that date to pay the settlement.
  • As a very general rule of thumb, it takes between 6 to 8 weeks from the time a settlement agreement is reached until the time you have your settlement check.
